Just to respond.

I haven't come across that information, do you have a link so I can verify it?

Unfortunately we don't know all the charges, how many expert witnesses they have, what evidence, etc etc so unless you listened in to the case investors like myself have no idea which side looked stronger.

With regard to Unique's case, I'd say the ACCC won't make that mistake again with their prosecutions, a $4.165m fine over 6 students despite losing the appeal is very serious money.

In Empower's case, the ACCC first instigated action in Dec 2015, they went into liquidation after that, agree they probably didn't put up much of a defence. A $26.5m fine & having to pay back $56m in VET fees is very serious coin.

the ACCC seem to have a good batting average, of the 7 prosecutions, they won 2, settled out of court with 3, 1 is still to be decided, they lost 1 appeal, but still managed to get a $4.165m fine imposed. several of these companies have gone into liquidation.
