I've spent the last 20 years in legal battles around Continuous Disclosure. (S674 of Corps Act, ASX Listing Rule 3.1, Guidance Note 8). It is all based around the "Reasonable Person" test or if 3.1A applies.
If CAY have information they must believe a Reasonable Person would NOT expect it to have a material effect on price or 3.1A applies. The real question should be, how does CAY define as a Reasonable Person?.... because their definition of Imminent is certainly different to mine!
