5.2 Did the Tribunal fail to consider a relevant consideration (Ground 2)?144 As earlier stated, the disposition of Ground 2 also turns upon the proper construction of the Tribunal’s reasons at [156] and its accompanying footnote. As I have already rejected Mr Wills’ construction of [156], it follows that Ground 2 must also be dismissed.
6. CONCLUSION145 For the reasons set out above, the appeal under s 44 of the AAT Act must be dismissed with costs.
