update from Pipers todayWe refer to our email dated 31 August 2023 below andwrite to provide an update on the Davis Proceeding.
Following the delivery of his Honour Justice Jackson’sjudgment in the ASIC Proceeding, the parties to the Davis Proceeding and ExcelTexel Proceeding attended a further mediation in September 2023, however theproceedings did not settle.
Consequently, in October 2023, the Davis Proceedingand Excel Texel Proceeding were reallocated to the docket of the HonourableJustice Yaseen Shariff and have now been listed for a five-week final hearingcommencing on 18 March 2024 before his Honour.
The proceedings are otherwise next listed before hisHonour Justice Shariff on 27 and 28 February 2024 for further case managementand the determination of any remaining objections relating to evidence that isto be relied on by the parties at the final hearing.
