Will the council allow you to remove the tree when you own the property? this is more of a council requirement rather than the state.
Have you had a quote on getting the tree removed?
As to stamp duty there are only two types, investment or home owner, probably as it is an adjacent property you could say that it is to be an extension of your own home for visitors, family etc therefore it attracts the lower stamp duty?
