I find page 3 of the attached document amusing, for which is stated:
"The parties agree that COMINIERE SA shall bear the sole responsibility for the litigation concerning the termination of the above-mentioned joint venture agreement initiated by AVZ International before the ICC in Paris under ICC 277720/SP and, where applicable, shall be solely liable to AVZ International."
This is an attempt to determine liability to litigation housed in a court whose purpose is not only to determine liability, but also the party liable (e.g. AVZ vs Cominere) and an attempt to preemptively contract out any obligation of liability.
Beyond this, it is acceptance within the agreement that there is the possibility of wrongdoing and an admission of potential wrongdoing. No reputable international operator would ever take on such a contract and sign on the bottom line - it not only says a lot about Cominiere, it says a lot about Zijin on the international stage.
Lucky we do not run our elections in such a manner...
