The fact the silk didn't run the application there and then tends to support the suggestion the ACTU doesn't believe in the application. The submissions must filed by 2.00pm Thursday. I can't wait to see if they notify the Commission they will not run the application as was foreshadowed, should they not intend to bring the application.

If the ACTU does intend to bring the application, I can't wait to see Commissioner Heydon deal with the application. Commissioner Heydon is one of the smartest men in Australia, he dealt daily with other smart judges and smart barristers. It will be great watching- bring it on.

I think the ACTU have backed themselves into a nasty little corner on this. The delaying tactics on Monday clearly showed they wanted this to play out during the week in parliament for political capital.
If they do not bring forward the application for dismissal on Thursday then I would expect the Commission to immediately commence charges of contempt against numerous persons, as evidenced by Mr Stoljar on Monday tendering into evidence the media reports and union letters accusing the Commisioner of bias .
Would dearly love to see a few Labor pollies and union heads dragged into the Commission to be dealt with...all broadcast live on ABC of course
