the article says the the High Court rejected the application on the grounds that it doesn't have the jursidiction to rule on this , these people are under the control of the ANNES administration, Australia has to approach this administration, I would suggest on a government level, the Australian court wouldn't have the power to order their release and repatriation., similar would be Australian Court ruling the the bloke China is holding be released because our court ordered it.
The full judgement will be released apparently 10 days after the decision, so should be in 4 or 5 days.
as in so many cases the headline is read and whips people into a lather, and the actual details aren't read.
