MALCOLM Turnbull could survive the biggest challenge to his leadership yet, with a new report suggesting his presumptive opponent Peter Dutton may be ineligible to serve as an MP.
In a new report on Ten Daily, constitutional law expert Professor Anne Twomey states that Mr Dutton's commercial interests in two Brisbane childcare centres which receive Commonwealth government subsidies could make him ineligible to serve in parliament, under Section 44 of the Constitution.
In response, Mr Dutton says he has legal advice he is eligible to remain in federal parliament.
