    The initial judgment must stand before any appeal can be entertained. Lehrmann who's bringing the action should first pay the winning side's legal fees (if that's the decision of the judge) before he can bring further action against the defendants. If Lehrmann can't meet those costs, ideally with demonstrated capacity to pay any additional fees that might be incurred he shouldn't have the right to subject the opposing side to ongoing financial duress. Not liking the initial verdict doesn't always give you the option to shop for a different one.
