There is no physical or scientific proof sex or a rape took place on the night, one person a judge has determined in all probabilities an assault took place after describing both of them(Lehrmann and Higgins) as reliable witnesses(ie liars).

Lee believed the security guard account that she entered the office around 5am and viewed Higgins naked on the couch and viewing an eyeful of Higgins private parts and when she asked Higgins how she was Britts replied "all good thanks".

So effectively Higgins has supposedly woken around 2am with Brucey having sex with her after pushing up her dress and taking advantage of the undieless Britts which she remembers clearly, then after that she decides to remove her dress herself then sleep it off with not a care in the world before waking up close to 10am where she scoffed some chocolates from the fridge and took a jacket from Reynolds office and just strolled out of Parliament House.

At this stage only one person in the court system believes in all probabilities a rape took place even after taking into account he considered Higgins a liar, just like the AFP and even Wilko was suspicious of her bruise photo story.

That 'one person' you refer to - the experienced and esteemed Justice Lee who presided over the case, listened to all the evidence, and pored over all documentation to arrive at his findings.
