Is there any requirement for him to prove he didn't make the comment? A court has already ruled that there has been no evidence provided to prove he did.(Innocent until proven guilty and all that)
It seems to me that Ms. Butler will need to prove he did make the comments or rely on some "opinion" defense which I would think would be rather difficult given the facts were widely known so there can surely be no excuse for making incorrect defamatory comments on live TV?
