Some good points there. Another advantage of BTE is that they will fit most ears whereas the NUH existing design depends a lot on the shape of the ear lobe which can be complex. However, they should fit enough ears to take a good market share.
A big problem with BTE though is the audio fidelity. The packaging is fairly narrow so they won't be able to use the 9mm round driver like NUH uses, and which produces such good bass response and a flat response throughout the audio range. They would have to use a balanced armature, probably several if they want a reasonably flat response. But they still won't get the base response and they will have to deal with mechanical resonances throughout the audio range.
Most reviews of the iQBuds Max site the audio as one of the best out there.
