While movements on the share register may be a mystery to all of us - and at best, all we get to see is broker data - the precise buys & sells and exact identities of shareholders is not a mystery to the issuer. VUL will have examined the share register data in detail since JCap launched its attack, and will know exactly what parcels of shares were bought and sold by the shorter and associates, how much the transactions were worth, what profit was derived from the attack, and what shares remained in their hands on the day of settlement. Shareholder data belongs to the company, people cannot transact invisibly on the issuer’s own register. Will make for a fascinating discovery process should shareholder litigation ensue. I suspect plenty of litigation funders would be happy to underwrite action just to see Tim Murray called to account.
