This is another case of the crime not being the problem but the cover up.
If Trump had returned all the documents when asked to do so & then not hidden documents & obstructed officials when they searched to make sure there weren't any more he wouldn't have been criminally charged.
The mistake Trump's team is making is saying they weren't confidental , he had the right to have them or that they'd been declassified.
Possession of the documents is not what he's going to get convicted on, it's on the obstruction charges trying to cover up the possession of them.
