So your question was "...did they deliberately not subpoena because they thought they'd do it during the trial, which in turn would cause a delay?"
And you get told explicitly... THEY DID JUST THAT/ They tried to serve her...she denied service...then lied about it...so they exercised their legal recourse to the Court and get denied unfairly.
