Thank you for your email enquiry. I cannot find any reference to the GTG-applera case on Reuters News - however your impression of the case being settled is incorrect as the case is still continuing.

Earlier this month, both organisations made presentations at a ‘Markman Hearing’, setting our their interpretations of 15 disputed terms before Judge Phyllis Hamilton in the US District Court, Northern District of California (San Francisco).

The purpose of the Markman Hearing was to rule definitively on the precise meaning of complex technical terms that appear within the GTG patent claims, as already granted to GTG by the US Patent Office. These definitions will be applied if the case proceeds to trial.

The Court ruled in favour of GTG in respect to 13 of the 15 disputed terms. The Court provided its own definition for the remaining two disputed terms, which were not inconsistent with GTG’s position.
