    The issue you raised is a very important one.

    I did ask my mate more than once in the past 6 months on this issue.

    What he said was that Anglo/ARM has been challenging the DMR since 2008 when the mineral rights were awarded to Genorah/NKP. I am told that they have been trying to challenge this decision more than once since 2008. Exact number of times I do not know.

    Subsequent Anglo/ARM has sort High Court recommendation with regards to a possible appeal against the DMR on the basis that the constitutional procedure was not followed. To date all these steps have been rejected. This also explains why Anglo/ARM have not gone to court officially to get an injunction because the chance is very very slim. Now you can understand the tactic where they are privately negotiating on the side to get as much as possible. The last agreement (or so we thought) was the swap of Hoepakrantz Farm for the use of Anglo downstream processing facility.

    The issue is an annoyance but to be fair when the mining right was given its pretty much the final verdict that Anglo/ARM will not get too far. If Anglo/ARM had a credible chance they would have launched a court injunction a long time ago.
