No I don't by any stretch think he has been shorting. If for arguments sake he does have a margin account, he could use this stock as collateral at his broker. Once it is collateral, he has no say of what happens to it as it is in the brokers' hand. Brokers speak amongst themselves to find lines of stock so that they can borrow it to short a stock. This is my guess - I am tipping it his stock that is being used to short nmg but he wouldn't be doing it knowingly. He would have no idea who the party would be or what broker for that matter.
