There definately seems to be some ambiguity around whether the shares will be in AGS or ACE, and how these shares are issued. However, they do state that the 59 million or so shares will be 14.9% of the company, which fits with the number of AGS shares on issue. And they also reiterate that they expect to be able to fund a stand alone plant from this (caveat surrounding forward looking statements etc. acknowledged). I agree that the nature of ACE shares could do with some clarification.

That said, I'm still pretty positive about this. My big worry, and that of many others here, was that ITOCHU would get shares based on the price of AGS before litigation was finished. And thus, if we regain 100% of 4-mile that would have been a rip off. Now that I know that the price will be decided after the court case, I'm confident that the market will re-rate AGS if appropriate. Also, I've noted that the definition of final determination is when there is no more possibiility of appeals. That could add on 6 months after the initial ruling (whichever way it may go). Either way, us pleb shareholders should have all the avaialabe information at that point, and either ITOCHU will pay fair value, or we can buy more shares ourselves if we think (based on finally full disclosure) that its undervalued.
