While I sit on the fence on the trigger in question, I can not help but notice the wording on page 12.
Malaysia Pre-Operating Permit means the Temporary Operation Phase of the Class A Milling Licence to be issued by the Atomic Energy Licensing Board of Malaysia.
Basically, approved but not issued is not good enough... there is no need to go to court as the word issued is clearly stated in explaining what is meant.
