Actually i like the ASX questions. About time Lynas were brought to account and shared with their holders.
2 Items for address by ASIC for Lynas
1. The Company?s announcement titled „Update on Malaysian Legal Proceedings? (the “Announcement”), lodged with ASX Limited (“ASX”) at 6:33 pm AEST and released to the market at 6:48 pm AEST on Tuesday, 25 September 2012, advising that the Kuantan High Court has decided to hear on 4 October 2012 an application by parties associated with the Save Malaysia Stop Lynas group for an injunction in respect of the Company?s Temporary Operating Licence for the Lynas Advanced Materials Plant (the “Decision”).
2. The 7.6% fall in the price of the Company?s securities from a high of $0.86 on 25 September 2012 to $0.795 at the close of trading on the same day.
Particular note made of laws
“an entity becomes aware of information if a director or executive director (in the case of a trust, director or executive officer of the responsible entity or management company) has, or ought reasonably to have, come into possession of the information in the course of the performance of their duties as a director or executive officer of that entity.”
Paragraph 17 of Guidance Note 8 – Continuous Disclosure further states that:
“once a director or executive officer becomes aware of information, he or she must immediately consider
whether that information should be given to ASX. An entity cannot delay giving information to ASX pending
formal sign-off or adoption by the board, for example.”
Having regard to the above definition, listing rule 3.1 and Guidance Note 8 - Continuous Disclosure, we ask that you answer the following questions in a format suitable for release to the market in accordance with listing rule 18.7A.
Lynas responses basically state that the 7% SP fall was initiated prior to the Kuantan announcement (nothing like a news leak is there NC).
The court decision is not going to effect Lynas. Wish i had their confidence.
1. The Company does not consider the Decision to be material to the Company.
2. The Company does not consider the Decision to be material for reasons including the following:
a. As noted in the Announcement, the Decision consisted of the issuance of "an interim order maintaining the status quo in respect of the TOL" pending a court hearing on 4 October 2012 and is not anticipated to impact on Lynas' planned schedule, because Lynas has planned for first feed to kiln at the Kuantan plant after 4 October 2012".
b. Over the past several months, the Company has periodically updated the market on the existence of various judicial review proceedings in Malaysia, and on developments concerning those judicial review proceedings. However, the Company does not consider all of those developments to be material. Several hearing dates have been set over the course of several months and the Company does not consider the setting of particular hearing dates alone to be material.
c. These judicial review proceedings were brought against departments of the Malaysian Government and therefore the Company was not a formal party to the hearing on 25 September 2012. However, as the Company's announcement on that day notes, both the Malaysian Government and the Company will strongly reassert the arguments that have been successful to date in the Kuala Lumpur High Court and the Malaysian Court of Appeal.

Although the Company's share price did fall over the course of trading on Tuesday 25 September, that decline had commenced before the Kuantan High Court reached its decision to grant the interim order (which we understand was handed down during the afternoon of 25 September AEST). In addition, the Company's share price has fluctuated generally since the announcement of the grant of the TOL on 5 September 2012 and its share price has improved recently without any further material announcements or developments (whether relating to the Decision or otherwise).
