Incorrect Bsmumisu - the court has the power to dismiss the case before the question of Lynas being a party is addressed. You will note that the SMSL comments were that the court wants to decide quickly on the prima facie case.
This is why Lynas also state about it having no impact on their schedule = they believe the court will say there is no case to answer for a JR or revocation.
