postponement until nov 8th, page-23

On 4 October I wrote,

"7. Strap yourself in because 10 October will be the day the application will run, but a decision may not be made there and then by the High Court, and a written decision may be given after 10 October so there may be more delay despite the application having been run."

Please stop the rubbish posts about the Malaysian legal system, NC suing people, NC getting injunctions blah blah blah. It is all nonsense. The court needs time to consider it's decision and time to hand down a written decision. In Australia in a case such as this the same would occur. To try and allege some grand conspiracy is rubbish. The matter is in the High Court at Kuantan, not in some backwater court house relating to some parking infringement. Frankly, if you aren't happy there is nothing that can be done other than applying the flasher's motto being 'Grin and bare it.'

As much as it is frustrating and seemingly futile if the company is successful it can operate under the TOL to it's full extent until the judicial review applications are heard. Then that will be another hurdle like this application is. If you are upset about this application and the court process get out of the company now because the same time frame for hearing and decision may occur again. If you truly believe that in the end the company will prevail as I do, all we can do it sit tight.

I have been violated by the market don't get me wrong, but like I keep writing in the end the company shall prevail in my view. If you believe the company won't prevail sell out now, don't subject yourself to the torment. Nothing will happen quickly or cheaply. If you are like me, persist knowing the misery and delay will reward you in then end. Not today, not tomorrow, not even on 8 November, but I hope the quarterly report announced April 2013 says all I need to hear about the operation of the plant, about the first feed, about the first shipment of REO, about the companies who want Lynas' REO, about the tonnes of concentrate extracted from the land etc. etc.

I will be the first to crack a beer when the injunction is lifted don't worry, but we must keep our powder dry until the company has legally, morally, socially and economically in the eloquent words of EJ Whitten, "Stuck it right up 'em, thats what you did, you stuck it right up 'em."
