rastus2, the court does not determine the safety of the plant or wether harm can occur - shouldn't be part of the rationale - i.e. it does not determine the merit aparently (according to the summary linked above).
However, it will look at wether AELB abused their power by disregarding """""credible""""" scientific evidence when making their desicion. Seems unlikely - a trifecta against would be pretty bad. Fine if JR review is approved - no reason why they can't get a review of the desicion. Knock-back to be a party probably doesn't matter that much as the AELB should be able to prove that they followed their own guidelines, but would be a feel good factor. TOL frozen would be the bad bit as the JR could drag on forever and a day... i.e. it's only really one of those that I care about :). Enought said - going to keep posts to a minimum for a while....
