Cadel, without being too simplistic, if we win we get damages, if we don't then we don't.
A win, in my opinion, is unlikely to lead to Kingaroy starting up again. I hope I'm wrong, but I see no point in throwing good money at a State which has no support for a decent energy policy. Far better, relocate the equipment to a foreign land where theres a better commercial return.
