The difference between manslaughter and murder is premeditation!
(If you intended or reasonably believed that your actions would likely cause death).
Hence why some states have now introduced or intend to introduce "one punch legislation". It is being introduced to fill the void between manslaughter and murder and provides harsher penalty guidelines than manslaughter but not as harsh as murder.
This epidemic must stop and slowly the legislators are waking up to this fact.
An unprovoked incident such as this where there was an obvious intent to cause harm will be viewed harshly by the courts i would hope!
