To be fair, the option was agreed on long before AC took over the reigns. He hasn't had much scope to negotiate the deal if Xstrata are dragging their feet, which they obviously have been doing.
I imagine his reaction on having it explained to him was something along the lines of "Who the hell drafted this piece of crap?!"
