KLH the guy on the other thread was smart enough to see the penny drop, I personally would have asked myself what does
"SPECIAL NUCLEAR FUEL" mean and why did the ASLB give GLE a license to use it?

because it isn't source material or byproduct i.e.
source material comes from the mines.
Byproduct comes from the depleted Uranium heaps at places like Paducah.

Special Nuclear Material comes from the Advanced Recycling Centers

See here What is meant by special nuclear material?

"Special nuclear material" (SNM) is defined by Title I of the Atomic Energy Act of 1954 as plutonium, uranium-233, or uranium enriched in the isotopes uranium-233 or uranium-235. The definition includes any other material that the Commission determines to be special nuclear material, but does not include source material. The NRC has not declared any other material as SNM.

Note where it says uranium-235,The definition includes any other material that the Commission determines to be special nuclear material, but does not include source material, you need to also understand that this is not byproduct, so if it isn't source material and it isn't byproduct, then just where does it come from?

The flow diagram on page 4 of

    http://nordic-gen4.org/wordpress/wp-conten...avid-Powell.pdf

shows exactly where it comes from, those smart enough to be able to read a simple flow diagram will understand.

here is what the ASLB licenced the GLE process to use:-

    http://www.nti.org/gsn/article/first-us-laser-enrichment-license-expected-months-end/
A permit would allow the energy giant “to possess and use source, byproduct and special nuclear material and to enrich uranium to a maximum of 8 percent … by a laser-based enrichment process” located in Wilmington, N.C., the board stated.

here is how the NRC refered to Special Nuclear Fuel:-

In response to sustained industry interest in reprocessing spent nuclear fuel, the NRC
continued developing a technical basis for rulemaking to establish the regulatory
framework for licensing a reprocessing facility.
    and here also

The Rulemaking Product Line provides support for the high-priority and mediumpriority rulemakings in FY 2013. The workload includes the final rule development
activities for 10 CFR Part 74, “Material Control and Accounting of ***Special Nuclear
Material*** Rulemaking” (the final rule will be sent to the Commission in April 2012).

So can you now see the connection

about reprocessing spent nuclear fuel and the term Special Nuclear Material?

do you now see that GLE have a licence from the ASLB to use this Special Nuclear Material?

    http://www.nrc.gov/materials/sp-nucmaterials.html
License and regulate the Nation’s civilian use of byproduct, source, and ***special nuclear materials*** to ensure adequate protection of public health and safety, promote the common defense and security, and protect the environment.
