Quiet day so did a bit of research on the thread heading:
The announcement was on the 10/04/2012 on both CRE and MMW

Wrong court in htread heading, should be Supreme Court of Western Australia.
Case has not been before a judge from what I can find so cannot tell if it is still waiting for a hearing date.

MMX was taken over by PAN in June 2012 and there is no mention of the proceedings from PAN.
No mention of proceeding by FML at all.
Conclusion: possibly a dead dog
