ASIC is responsible for administering the Corporations Act, so when someone calls me about my complaint I will ask about the process for an EGM.
It should be easy enough to write up, but there are a few things I am not sure of, like:
- The process required for signatures; it would be better if some kind of online/email method would suffice but I imagine everyone would be required to physically sign a document then fax/email to one person for consolidation.
- Whether 'asking for more information' is enough, or whether we have to propose resolutions and what qualifies as a resolution.
- How the letter requesting an EGM needs to be delivered to SDL.
Forcing an EGM would be the best way to bring attention to this and get the media involved.
