Just my thoughts but there are two (of many) interesting possible conclusions to the court case.
    a) AVQ and SMM battle it out to the end and the winner takes all - assuming it is AVQ then SMM pays up for damages (eg court costs, lost revenue etc)
    b) AVQ submits a significant damages claim against SMM and they realise that they can't afford to loose this case and stop it before it goes to court.

This puts the ball in AVQ's hands as they are driving the court case and they will have to agree with SMM's offer/request to stop??? Don't AVQ have a legal agreement that SMM will pay for damages regardless of the case being carried through to the end (thats why the injunction was put in place?)?

Not being clued up on the legal side of things but what happens if SMM can't afford the damages bill? Does Sumitomo have to pick it up or is SMM bankrupt? Any info on how big SMM is/ what they can afford?

Any guesses on the damages bill? Court fees to date alone would be a handy boost to the bottom line - lost revenue would be massive???

PS sorry about all the "?"
