That was my reading of the update too, Billy - based on the assumption that ACE had discovered more evidence to support their claim (that is strengthening the claim rather than weakening it as a result of "discovering" errors in the original claim). ... So, yes, I agree, a rejection of the amended claim using the first assumption would be expected .. But on what grounds and to what affect? Does the original claim then stand leading to a firm trial date as you suggest?
That the respondent can consent or not suggests there must be rules governing changes to statements of claims.
Just my thoughts though as I have no experience re claims - other than the mundane.
Any legal eagles out there who can clarify for us ??
Does look like JM wants it done and dusted, doesn't it ? .. Would love to know his thoughts on the matter ...
