If the World community was aware of problems within a state or region and failed to act should those with the means to act be held accountable.
Or worse still a country wished to act but was prevented from doing so by international law or the UN. If genocide or similar occurred should the survivors be allowed to sue such bodies.
Punishing the perpetrators is one thing but what of those that refused or were unwilling to attempt to prevent it!
Certainly gets very muddy because it’s not too hard to find some that are willing to commit genocide etc with the right motivation.
I guess a Lawyer could argue that even if the U.N did not have the means to act but as it is a representation of the World community they must shoulder some of the responsibility.
Certainly puts a different spin on Crimes against Humanity.
