I reviewed the actual complaint yesterday. It is not a whistle blowers suit and the SEC and FDA are not involved. It is limited to Todd Smith seeking recovery of lost wages and stock options. The reason "whistle blower" is mentioned is Smith claims that his firing was in retaliation for him blowing the whistle on Unilife’s alleged activities. From what I can tell the SEC and FDA declined to take action on this claims.

I am inclined to believe the Unilife story, they are not stupid and it would be incredibly stupid to falsify validation of product in filings to the SEC and Sanofi.
