If you read the response from EGO you will see that they cleverly avoid saying that ERM never approached them about any dissatisfaction with any concerns about progress or blowout in costs.
The lack of communication aspect they talk about purely relates to ERM taking this "course without any prior communication with Empire that ERM wished to have Board representation."
EGO doesn't actually appear to say that they had no knowledge of ERM's disenfranchisement or any words to that effect.
