    Understand your point, but I feel you may have it wrong. My research has led me to this sequence of events, correct me if I am wrong.

    At the time of the decision (the result) the judge will then probably be advised of an appeal, at this point he can choose to keep or lift the injunction for the process of the appeal.

    So even with a positive result AVQ still could possibly still not mine, that is why for me, the injunction ruling at that point is critical, because either way SMM will probably appeal.
    An Appeals court (highly unlikely to overturn the High Court) in my research is a viable process. However, with the injunction lifted and mining commenced very SMM will find it very hard to stop us then.
    You seem to give strong opinions on people understanding the process, so am assuming you have knowledge in this area, and keen to hear your thoughts?

    I my opinion, AVQ can win this case (can, not will!), but must win the injunction lifting at the point of AN appeal... at that point SMM will have lost the scenario to negotiate a JV, so therefore if the case is finished this week... THEN it is possibly SMM will quickly negotiate a JV prior to the delivery of the verdict if they feel the appeal will not lift the injunction... (probably based on the strength of the AVQ case). Highway111 is therefore identifying this possibility... SO I am deciding not to sell in the short term in the case that this may happen, and thus a lot of other long termers riding the wave. Don't get caught with your pants down is the expression I heard. However, in my opinion it is highly likely this case will drift to January... either way I am holding on.
