The companies beef is obviously with Krupp or IndexEMS. As for the $11 million in claims who knows for what amount is contributed to not having it being commissioned by the 23st of December 2012. The last house I had built the builders were liable for $250 per day each day past the agreed completion date, their is always inclement weather clauses and clauses pertaining to delays caused by the customer (changes) and its one for the lawyers.
You have reminded us constantly on this forum that the completion of the crushing circuit was behind schedule but are now jumping up and down for the company informing the share holders that they are trying to recoup money caused by those delays. Also I think your header is misleading because no were do I read the crusher isn't currently performing properly but rather stating the costs incurred to rectify the problems plus contractual penalties per day for the delays caused in final commissioning.
