BWB, my take on it is that the strategy here is to be as annoying as possible - a supreme nuisance - and to use that leverage to get Statoil to the point where they'd rather settle than continue. I've seen it succeed in the past but generally you need a fairly unique skill-set to make it work and to be able to apply pressure to a much larger opponent. I have no detailed knowledge of what the docs say, but for the strategy to have any hope of success they need at least an arguable case - something with a chance of succeeding in court. So if BKP's claim doesn't get struck out then that would suggest that they have such an arguable proposition.
I guess we'll see.
In the meantime I've been told that it won't hold up the Statoil drilling program so that's at least a small positive.
