No arguments from me vintage, I posted verbatim what was sent to me as a prompt for further thought.
All it got was queries regarding a posters whereabouts, not one comment otherwise just another de-railed thread. Also it answered newborns query as it turned out, and possibly others with the same query.
I am of the opinion all information should be posted and disseminated, right or wrong.
You would be preaching to the converted over the process PEN/Strata has had to follow. It was me that pointed out many years ago that PEN would be the first to be permitted under the new GEIS/SEIS process. Clearly the NRDC are going to use this as a test case to attempt to gain legal precedence and changes to the process.
Mudguts suggested there may be the possibility of precedence and I put it up hopefully gain comment, thanks for you input on that. At first I thought there may have been, however you put up a compelling case why there is not.
I agree this outcome is unpredictable and agreed with Zubana that 3 of the 4 stay requirements a arguable. The fourth remains to be seen.
My thought now is how can they prove "irreparable injury" over the contentions in play, if they haven't yet been heard? If a stay is granted for them then it implies they will be found to be in favour of the claimants without Hearing or investigation. Simply can't see how they can claim on that basis.
This is far from over.
