So Dr KSS believes that Benitec have presented themselves falsely and are deliberately sabotaging their own trial eh? ... bit of a sudden turnaround from their number one spruiker. He claims that the body mass index requirement has been used by Benitec to knock back perfectly good candidates that have been selected by Duke?

Sorry Doctor .... but that requirement is on the list of criteria that Duke are working to and so they would not have considered anyone outside that body mass in the first place

Furthermore you state in your article "The TT-034 trial, which Benitec would have you believe is of a magic bullet for HCV" ? ... well I think you agreed with them

Let me refresh your memory .... you have been the number one pusher for the science and you have shoved your beliefs down everyone's throat. When Dr Kaye's work cast some doubt on the ability of the delivery vector to be effective, you wrote an open letter to Benitec reassuring them that they were 100% on the right track and lent your scientific medical reasoning to their approach. One doctor on a forum stated that he had indeed been taken aback by Kaye's work until he read your letter.

Further to the above .... TT-034 has been shown to work in mice and primates and has been developed under a "Big Pharma" regime by Pfizer .... not in the back of "Joe's Hamburger Shop" .... refining the delivery vector maybe the main stumbling block, but Benitec seem pretty confident.

Since the day that Duke opened the recruitment for this trial, the rumour of Benitec knocking back perfectly good candidates has been circulating American Forums. It appears that in your anger about the lack of communication regarding the European Patent hearing has prompted you to say things you may not otherwise have said, given a few deep breaths.

At the end of the day, Benitec and their Peers are dealing with very difficult diseases to cure in HCV, HBV and HIV. The upcoming trial is not really about hitting a cure for HCV first time [although it would be a bonus] .... this is the first trial of it's type and the safety and efficacy issues are of massive importance for the future. Get that part right and cures are only a matter of time.

Benitec's real value is more likely to be realised far more quickly by the trial of it's NSLC pipeline, which seems to have been forgotten. In the initial work done at the University of NSW, this was a success far beyond expectation and looks to be a winner

SO WHAT DOES THE EUROPEAN PATENT DECISION MEAN?

not much ....

Benitec have been through all this before and as with the US and British hearings, will eventually win on appeal ...

If they don't? .... well, it doesn't much matter as they have done a licensing deal anyway. Benitec will succeed by producing the goods .... not by licensing out their technology to the doers of the world.

Finally ..... I have been and remain extremely critical of Benitec's communication with shareholders. All of the share price drops and all the recent anger toward the Company, including the outburst by their biggest supporter in Dr KSS is !00% due to a lack of updates and transparency with those they should consider most important.

That being said ..... I have confidence in the Company's position and the product.
