Some effort was spent amending the Mining Act (2004 I think?), with the view to encouraging the very issues you mentioned...mainly, the "use it or lose" it ploicy!
What better example to set for the industry, than to refuse RIO's claims and in the process, put up a pretty good example of the governments new objective of a more invigorated and fair mining industry.
