    So the fact that palestinians are actually trying to kill civilians doesn't matter to you? it isn't whether or not the attacks are unsuccessful, it's that the attacks take place.

    The ICJ trial test trial I took part n was primarily concerned with the administration of Jerusalem in a two state solution. currently the UN administers Jerusalem with day to day running spread out amongst a number of local authorities. we were concerned in looking at how this could be bettered or changed in the even of a formal recognition of palestine as a nation (currently only with observer status so no voting powers and no powers to bring issues before the UN in an official capacity). As part of the trial we worked with Israeli historians and academic in Tel a viv and the red cross in Gaza. of course as part of the investigation the issue of Gaza was central: the border control and so forth.

    the real stumbling block to a two state solution was the return of palestinian Israelis to israel as part of the peace accord. An influx of millions of ethnic palestinians to a currently jewish majority country, instantly changing the demographic of Israel meaning the Jewish majority became a minority. this, of course has serious implications for the survival of israel as a jewish state and would never pass muster with the Israelis.

    to cut a long story short, no UN case involving palestine will ever be successful unless they get full recognition as a member state.

    People also forget how small an area the fighting is happening in. Gaza is pretty densely populated in many areas, maybe 10 -15k wide at the widest and 40km long. smaller than the area of sydney or mebourne.
