When the US government needs Lani in emergency, they can just produce as much lani as they need without paying Biota a cent. That is the LAW in the US. It is because Biota now is a US company. If Biota wants to move back to Australia, it has to be approved by the US government.

IMHO, the failure of this Lani Phase II trail was largely due to the over-confidence of the management and the mis-design of the trial. The trial had got too many centres and too short time, coupled with low flu season. For example, It is hard to quality control so many centres and the results reported can be easily biased.

Finally, conspiracy theory is that there is very high chance that BARDA does not want Lani to be on the market and widely used and wants to reserve Lani for emergent times, such as when Tamiflu resistant viruses are prevalent.
