As someone who doesn't have any skin in the game I've gotta say this sounds like a fair question to me.
And this by bobbyg411 from the AGI AGM thread, seems like a fair statement:
"If the company has withheld market-sensitive information, information it seems to have provided to a select few, the company/board certainly has some questions to answer..."
