Still ongoing as far as I know. Bennett and the Marshalls tried to have the defamation case thrown out, they were unsuccessful as per the decision handed down on 6/6/14:

And the judge awarded costs against the Marshalls, if I read it correctly he punished them somewhat by awarding a greater than normal amount, although not as much as Smith had been requesting.
