There is no defaulter if the construction is stopped via the councils court action.

Which was the legal advise and the reason Andrews was considering supporting Morland\Yarra councils in their court action, which would have stopped the construction without Andrews cancelling or defaulting.

When the Treasury guarantee was revealed, the above was no longer an option.
