The Minister would have to have made a legal and proper decision, knowing full well CAZ's response to ny decision. However, what may be a subject of debate is the tranparency of the decision making process and I do find it odd that it was mormal due process that CAZ was not aware of RIO's full submissions when they themselves were providing submissions. I would have thought CAZ would have a right of reply.

Both State and C/wlth decision making bodies tend to hide behind FOI. I believe the Minister would have discretion regarding CAZ's FOI request.
