    the submissions only ever served one purpose. that being to defend your position. i personally do not know why they are really actually required when the circumstances were known anyway, in any case, i think only 1 submission per side should have been allowed. Enough to simply state your case and then wait for a prompt decision.

    but even then .. the FACTS of the case would be known without the need for submissions, and the FACTS are the only things I believe which make any difference. some would argue the public interest case, however, public interest would be determined by the facts.

    guys, in my very first class of law at uni, I was told a very very fundamental principal of law and was told by the lawyer that it applies to ALL law. its a simple process he explained:

    1. acquire all the FACTS
    2. gain a thorough understanding of all the applicable LAW
    3. APPLY the LAW to the FACTS
    4. state a conclusion.

    in all my lectures and tutes I only ever recall getting one case wrong using that method. strayed from the method a few times and stuffed things up, but when u take that method in viewing judicial assesments, it works every time, and its very simple!!

    we were frequently given cases with the verdict missing and asked to come up with teh verdict to test our knowledge and application of various laws. we'd later be given the verdict. very few folks got it wrong when using that lawyer's method.
