    But it was RIO's fault. RIO had the responsibility to ensure, to check, to follow, to guarantee the delivery was made on time.

    RIO had HEAPS of TIME in which to accomplish their PRIMARY responsibility. To ensure they do not forfeit the lease by being late, but for the grace of a man who thinks he can play demigod in good conscience.

    That's like a demigod saying "we go to war because we are good people, the most supremely moral and most perfect nation among all nations of earth, and we happen to also be supremely powerful which humbles us as we deliver to our enemy a war that, if and when we chose the time and place, can go beyond the enemy's wildest dreams and expectation of shock and awe". Ha Ha Ha!

    Smelly stuff happens every day of our lives. It is one of the driving forces that keeps us on our toes. And the response "stiff cheese" is bandied about by winners and those who like making meaningful contributions to a debate.

    EQUITY is not a-bout the purity and innocence of a Party to a dispute. Though that is needed to qualify for an equitable remedy. It is about justice when the operation of the law would have produced an injustice.

    So, when is failure to act responsibly the subject of an equitable remedy? I sense I'm not sophisticted enough to fully answer that question. Only to ask it.

    Still, I personally can not see how equity can be argued.

    I agree. Except:

    1. That's how all opposition parties work. It’s the nature
    of the beast, the system. And its better than not
    having an opposition.

    Better than allowing Bowler to not publish his
    reasons.

    Could you imagine that? He actually did decide to
    not publish! Which sows that the decision was part
    political. Because Bowler said he had initial legal
    advice to Not Publish (or was that advice to say he
    need not publish?).

    But he did decide to. Why? Because the decision,
    like his change of mind, the decision is political as
    well.

    Though I doubt the WA Opposition persuade Bowler.
    I’d like to take most of the credit for forcing Bowler's
    hand.

    Its a measure of the power of people like me who,
    post comments at HC and who suffer a false sense
    of sophistication. Why? Because it helps to have
    just a tinge of illusion about oneself. Just as, I
    expect, Bowler has, regarding the adequacy of his
    arguments. I TOLD YOU ALL THAT I sensed Bowler
    was taking so long because he was trying to add an
    element of himself into he decision.

    That's why THEY call it the Bowler decision......ok,
    I coined the term first at HC.

    2. "False legitimacy"? Personally I expect
    garbage at HC. Its the nature of the beast.

    Think of it as brain storming. Now that should give
    you scope to attack!

    3. If only real experts could make comments at HC. And
    if only it then stayed a FREE place for picking up
    market tips. Except economists are experts. And
    their guess is often as good as an id-iots.

    So, will there be a rate rise next week? Try asking
    an id-iot like me. I reckon No. I come to that
    conclusion because I sometimes listen
    to the experts and sometimes I suffer from a false
    sense of sophistication.

    Trouble is, its hard to distinguish one from the other when
    measured by accuracy of outcomes. Even an id-iot
    can predict next week will be 50:50. But experts do
    have their place in the scheme of things.

    Now where have I heard that before? 50:50?

    Like when I rely on my spelling checker. I always
    trust it! Because it has proven itself to be very sofisticated.

    But HC is mostly a place for people to spread rumour
    and gossip. I've never expected anything better
    than moral support and opposition. It’s the nature of
    that beast too, I reckon.

    Don't you think its fun? With serious money being
    thrown around? Of course.
